Posting other site's content

Lately there have been a couple of discussions about how/what to post from competitive sites - especially since Fall camp started. To make sure we're all on the same page, here are some basic posting guidelines to keep in mind as we move forward:
 
1. Posting a working link with proper attribution is always okay.
2. Posting a copy/paste of their proprietary content is not okay.
3. Posting a summary of their content (in your own words) is okay with credit to the source (ex: 247 is reporting...).
 
 
This market is a big family. We have good relationships with staffers at all the competing sites. Following the above guidelines is the best way to keep it friendly. Thanks for your help!
 
I have always wondered about the area of "fair use."

The rules are different for the internet.  What passes for fair use here would not pass muster in the publishing world.

But (1) this is not the publishing world, and (2) I admit am one of the worst fair use abusers (but I do always link the original)

The reason I am over-inclusive is to make it easiest on the reader.  Why make them click links -- have their behavior tracked by advertisers and the NSA?

Same with my tendency to embed entire tweets (which some folks here clearly hate).  But the reason is so that the originator gets the credit as he/she should (or hopefully it's the originator, not always easy to tell)

If I understand you correctly, what you mean by "proprietary content" is "material behind a paywall." 

If this is correct then you did not directly address my question about fair use.  So, unless you call me out for it directly, then I am going to proceed with what I have been doing.

In general when posting content from another site, whether there is a paywall or not, it is covered by Copyright, even if they do not have a copyright "all rights reserved" listed. The time this is not the case is if the put a Create Commons license on the site saying you can copy the content as long as you follow the listed rules (generally attributation).

I worked with a company out of SA that was fine $400k for copying content from another site. They ended up settling for $125k. It was literally part of a paragraph from a online tech news site.

Forums are a grey area and often have a lot of infringement, however they are targets as well. Generally if someone presses the issue it is similar to a DMCA request to have the offending post removed. Although that is not always the case.
